This bill amends Section 6600 of the Labor Code to clarify the process for employers appealing citations or notices related to workplace safety violations. Specifically, it states that if an employer appeals a citation for a serious violation, repeat serious violation, willful serious violation, or failure to abate, the deadlines and requirements for fixing the unsafe condition (abatement) will not be paused unless the employer requests and receives a stay from the Division of Occupational Safety and Health (the "division"). The division will grant this stay only if the employer has a strong chance of winning their appeal and if pausing the abatement won't put employees' health and safety at risk. The bill also allows employers to request an expedited hearing for their appeals.
