This bill requires executive branch departments in Hawaii to make appropriate and existing electronic data sets available to the public through the State's open data portal, data.hawaii.gov, or its successor, unless legally prohibited, without creating new data sets or making them available on demand, and with exceptions for data licensed to the State or containing personally identifiable information without consent or lawful necessity. The Chief Information Officer (CIO) will oversee this process, establishing policies and procedures for data disclosure, technical standards for accessibility, and guidelines for departments, while ensuring data is updated regularly to maintain its usefulness and integrity. The bill defines "data" as final, digitally transmittable statistical or factual information owned by a department and related to its mission, and "data set" as a named collection of related electronic records. It also clarifies that the State will not be liable for deficiencies in data completeness or accuracy unless there is gross negligence, wilful and wanton misconduct, or intentional misconduct, and allows the CIO to license data sets to third parties. Furthermore, the bill appropriates funds for fiscal years 2013-2014 and 2014-2015 to support this open data initiative, which aims to increase public awareness and access to government data, enhance transparency, encourage engagement, and stimulate innovation.
