This bill prohibits the use of "scanbacks" and instantly redeemable coupons for the sale of alcoholic malt beverages in the state of New Mexico. Scanbacks are reimbursement payments made to retailers by manufacturers, importers, or wholesalers based on the number of units of a particular alcoholic malt beverage product sold during a promotional period. Coupons are defined as instantly redeemable coupons issued to retailers that allow customers to deduct a specified amount from the normal price of a particular alcoholic malt beverage product. The bill makes it unlawful for non-retail licensees, such as manufacturers, importers, or wholesalers, to offer, fund, produce, sponsor, promote, furnish, or redeem these types of coupons or scanbacks. The provisions of the bill will take effect on July 1, 2018.
