This bill, the Data Care Act of 2018, establishes duties for online service providers (companies that collect personal data from users) to reasonably secure and protect that data, avoid using it in ways that harm users, and maintain the confidentiality of the data. The bill gives the Federal Trade Commission (FTC) the authority to enforce these duties and allows state attorneys general to also bring civil actions against providers that violate the law. The bill also prohibits providers from contractually limiting users' rights and remedies under the law.
